Congratulations on receiving your photoshoot gift voucher – I can’t wait to meet you!
Here’s the small print boring bit – your photoshoot terms and conditions.
There’s nothing to worry about – it’s all just fairly standard stuff, setting out how the voucher can be used as well as how you’ll be able to enjoy your images.
VOUCHER USE AND VALIDITY PERIOD
Vouchers hold no cash value and cannot be refunded or exchanged.
Vouchers are valid for one year from date of purchase. Please do get in touch with me as soon as possible to book your shoot – dates get booked quickly, especially during peak periods.
FEES, CANCELLATION AND POSTPONEMENT
Your photoshoot has been pre-paid and gifted to you. There is nothing additional for you to pay, other than should you wish to order additional images or print products from your gallery or if I need to travel more than 60 miles round trip for your shoot.
Your gift voucher must be redeemed within one year of purchase.
You may cancel your booking at any time by giving me written notice, but in doing so will forfeit your gift voucher.
You may postpone your photoshoot, without additional charge, up to a limit of one rearranged shoot, provided notice to reschedule is given in writing not less than 2 weeks prior to the date of the photoshoot. In the event that no suitable alternative date can be found, you will forfeit your gift voucher. If notice of postponement is received less than two weeks prior to the date of the photoshoot, and a suitable alternative date is unavailable, the shoot will be deemed cancelled by yourself and your gift voucher forfeited.
Rain and weather postponements – I’ll shoot in light drizzle, but a photoshoot in torrential rain is no fun for anyone. We’ll keep an eye on the forecast and in the event of significantly poor weather we will seek to agree a mutually convenient alternative date.
IMAGES AND COPYRIGHT
The photographic coverage will be as my professional expertise determines and that no one photograph will be deemed more important than another. I shall be granted complete artistic licence in relation to the poses photographed and the locations used. I will make my best effort to honour requested photographs, but do not guarantee any specific picture, nor any specific background, location or group arrangement. Due to the weather and the willingness of the subjects it may not be possible to capture all the images requested.
You will receive a package of fully edited digital images (High Resolution Jpeg) which will be sent via an online gallery for download and sharing. The amount of digital files available for download is subject to the type of gift voucher you’ve received.
I am not liable to deliver every image taken. The determination of images delivered is at my professional discretion.
Your online gallery will be live for one year (please do not rely on the online gallery for storage of your images – it is your responsibility to download, save and keep your image files). The online gallery gives gallery visitors the option to view and purchase images and prints directly.
I aim to deliver your full gallery of images within 4-6 weeks of your photoshoot. Prints and albums are available at additional cost.
All image sizes are nominal. I will edit images to provide a pleasing colour balance but cannot guarantee exact colour matching owing to anomalous reflectance caused by a combination of certain dyes and materials especially in man-made fibres. It is sometimes impossible to record digitally the exact colour as seen by the human eye. All images will be adjusted for exposure, brightness, contrast, sharpness, etc to ensure a consistent editing style across the collection of images. My judgement regarding the final post production and editing style shall be final.
Any images or copies of images whether stored digitally or otherwise and any computer programme including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright, Designs and Patents Act 1988. It is contrary to the Act to copy or allow to be copied photographically or electronically or by any other means an image created as part of this contract without my express written permission.
All digital files remain my property. You are granted a license to make copies and prints of any images purchased for personal use only and for no profitable gain – no selling on.
Copyright of these images is retained by myself – Joanne Quint of Quintessential Photography. All digital files remain my property. The condition of digital files stored with Quintessential Photography cannot be guaranteed although every effort will be made to back up and safeguard your files. It is your responsibility to download, save and keep secure your image files once delivered. I am under no obligation to, and am unable to hold image files indefinitely.
You agree not to edit or otherwise alter any image received from Quintessential Photography.
CONSENT TO USE IMAGES
In order to be able to run my photography business I need to be able to display and showcase examples of my work online and in print. Typically this includes featuring images on my website, as well as on my business Facebook page and other social media such as Instagram. On occasion, I may wish to submit images for award entries, or for submission to suitable third party blogs that I know and trust. I may also wish to use imagery on print marketing materials, such as leaflets, flyers, exhibition stands, studio wall art and business cards. I don’t overshare and you’ll have time to look at and enjoy your gallery of images first – and to let me know if there’s any image you’d rather not have shared. There is no obligation for you to consent to your images being used in this way, though as a small business it is always very much appreciated.
THIRD PARTY PRINTING
I cannot accept any responsibility or liability for colour balance or quality of any prints reproduced by third party printers such as high street photo processing shops.
COMPLAINTS AND LIMIT OF LIABILITY
In the unlikely event that I am unable to attend due to unforeseen circumstances, every effort will be made to rearrange the photoshoot for a mutually convenient date, or to appoint another photographer to attend in my absence.
In the unlikely event that digital files are lost, stolen, or destroyed for reasons beyond my control, including but not limited to camera, hard drive, or equipment malfunction, my liability is limited to the value of the gift voucher purchase price. The limit of liability for a partial loss of images shall be a prorated amount based on the percentage of total number of originals. Neither party shall be liable for indirect or consequential loss.
Please let me know of any complaints in writing as soon as possible and in any event within 14 days of receipt of the images.
TRAVEL EXPENSES
Travel expenses within 60 mile round trip of SG4 9NQ are inclusive of the gift voucher. Additional mileage will be charged at 40p per mile.
